1. Agreement to Terms

By accessing or using LegacyCast ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

LegacyCast is a voice-to-book platform that allows users to create personal memoir books by recording stories, answering follow-up questions, and editing AI-generated chapter drafts. The Service includes:

  • Audio recording and transcription
  • AI-powered question generation and content creation
  • Rich text editing tools
  • PDF and EPUB export

3. Account Registration

  • You must be at least 13 years old to use the Service.
  • You must provide accurate and complete registration information.
  • You are responsible for maintaining the security of your account.
  • You must notify us immediately of any unauthorized access.
  • One person may not maintain multiple free accounts.

4. Pricing and Payment

4.1 Pricing

  • Starter: $49 one-time payment
  • Plus: $99 one-time payment
  • Pro: $199 one-time payment

4.2 Payment Terms

  • All payments are processed securely through Stripe.
  • Prices are in US dollars unless otherwise stated.
  • Payment grants you access to the features of your selected tier.

4.3 Refund Policy

We offer a 30-day money-back guarantee. If you are not satisfied with the Service within 30 days of purchase, contact support@legacycast.com for a full refund.

Refunds are not available after 30 days or if you have exported a completed book.

5. Acceptable Use

You agree NOT to:

  • Upload content that infringes on intellectual property rights
  • Upload illegal, harmful, threatening, or defamatory content
  • Use the Service to generate content about third parties without their consent
  • Attempt to reverse engineer or exploit the Service
  • Use automated tools to access the Service without permission
  • Share account credentials with others
  • Resell or commercially exploit generated content without authorization
  • Upload malware or attempt to compromise system security

6. Content Ownership

6.1 Your Content

You retain all ownership rights to your original content (recordings, stories, photos). By using the Service, you grant us a limited license to process your content for the purpose of providing the Service.

6.2 Generated Content

The AI-generated content (transcripts, questions, chapter drafts) created by the Service is owned by you. You may use, modify, publish, and distribute this content as you wish.

6.3 Our Rights

We retain all rights to the LegacyCast platform, branding, and underlying technology. Nothing in these Terms transfers any intellectual property rights in the Service to you.

7. Privacy

Your use of the Service is governed by our Privacy Policy, which explains how we collect, use, and protect your information.

8. Third-Party Services

The Service integrates with third-party providers:

  • Clerk: Authentication services
  • Stripe: Payment processing
  • OpenAI: Audio transcription
  • Anthropic: AI content generation
  • Cloudflare: File storage

Your use of these services is subject to their respective terms and policies.

9. Service Availability

  • We strive for high availability but do not guarantee 100% uptime.
  • We may perform maintenance that temporarily affects access.
  • We reserve the right to modify or discontinue features with reasonable notice.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • The Service is provided "AS IS" without warranties of any kind, express or implied.
  • We are not liable for any indirect, incidental, special, or consequential damages.
  • Our total liability shall not exceed the amount you paid for the Service.
  • We are not responsible for content accuracy or third-party actions.

11. Indemnification

You agree to indemnify and hold harmless LegacyCast from any claims arising from your use of the Service, your content, or your violation of these Terms.

12. Termination

  • You may cancel your account at any time from your account settings.
  • We may suspend or terminate accounts that violate these Terms.
  • Upon termination, your data will be deleted according to our Privacy Policy.

13. Dispute Resolution

Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Class action lawsuits and class-wide arbitrations are not permitted.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use after changes constitutes acceptance.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
